IZI1 Package Protection Terms & Conditions

These IZI1 PACKAGE PROTECTION TERMS & CONDITIONS (these “Package Protection Terms”) govern any optional package-protection service offered by IZI1 LLC (“IZI1”) or its Partners in connection with eligible shipments booked through the Platform. These Package Protection Terms supplement the IZI1 Master Platform Service Terms & Conditions (the “Master Terms”) and any applicable Global Parcel or other service-specific terms, each of which is incorporated herein by reference. Package protection is not cargo insurance, parcel insurance, marine insurance, or any other insurance product, and IZI1 is not acting as an insurer, insurance producer, insurance broker, or insurance underwriter unless expressly stated otherwise in a separate written instrument.
- Scope; Eligibility. Package protection, if offered, is available only for eligible outbound shipments for which the package-protection option is affirmatively selected and the applicable package-protection fee is successfully paid before shipment checkout is completed. Package protection is offered only for the specific shipment identified at checkout, is non-transferable, and may be unavailable for certain carriers, destinations, commodities, shipment values, membership tiers, or risk categories. IZI1 and its Partners may determine eligibility, availability, and pricing in their discretion, to the maximum extent permitted by law.
- Attachment and Coverage Period. If validly purchased, package protection attaches only after the protected shipment is physically tendered by IZI1 or the applicable Partner to the selected outbound carrier and only for the transit period associated with that outbound shipment, subject to these Package Protection Terms. Package protection does not apply before carrier tender, while goods are in merchant transit to a Facility, while goods are held in storage before shipment checkout, after a shipment is returned to sender or otherwise rerouted outside the originally protected movement, or after final delivery except to the limited extent a specifically covered post-delivery theft event is expressly included below.
- Covered Events. Subject to all exclusions, conditions, evidentiary requirements, and claim procedures in these Package Protection Terms, a “Covered Event” means one of the following occurring during the applicable coverage period and only to the extent expressly covered for the protected shipment:
- Total Loss in Transit, meaning the protected shipment is lost in transit and is not delivered after the applicable investigation period;
- Partial Loss or Missing Contents, meaning one or more protected goods are physically lost from the protected shipment in transit;
- Physical Damage in Transit, meaning protected goods sustain physical damage caused by an external transit event; or
- Post-Delivery Theft, but only if expressly offered for the applicable shipment and destination, meaning theft of the protected shipment from the delivery location after carrier-marked delivery. A shipment is not deemed lost, stolen, damaged, or short merely because delivery is delayed, tracking is incomplete, an expected scan is missing, or a carrier investigation remains pending.
- Claim Timing; Wait Periods; Reporting Windows. Unless IZI1 states otherwise in writing for a specific protected lane, carrier, or program: (a) a loss claim may not be filed until [21 DAYS] after the ship date or last meaningful tracking event; (b) a damage claim must be reported within [14 DAYS] after delivery; (c) a theft claim, if eligible, must be reported promptly and in any event within [14 DAYS] after delivery; and (d) no package-protection claim may be submitted later than [60 DAYS] after the earlier of the delivery date, scheduled delivery date, or date on which the shipment is reasonably treated as lost, unless a longer period is required by law. Failure to comply with these timing rules may bar the claim to the maximum extent permitted by law.
- Claim Trigger Standards. Unless IZI1 states otherwise in writing for a specific program or destination, a shipment may be treated as potentially lost only after a commercially reasonable investigation period and only if the carrier tracking has not shown delivery or meaningful movement for a reasonable period determined by IZI1 in light of the lane, carrier, destination, and available tracking data. A damage claim requires evidence of physical damage to the protected goods or packaging consistent with transit damage. A theft claim, if eligible, requires evidence reasonably satisfactory to IZI1 that the shipment was delivered and then wrongfully taken from the delivery location without the involvement of the recipient or persons under the recipient’s control.
- Exclusions. Package protection does not apply to, and no claim will be paid for, any loss, shortage, damage, expense, or other event arising out of or relating to: (a) delay, late delivery, missed delivery windows, loss of market, loss of use, loss of profits, or other consequential or indirect damages; (b) prohibited or restricted goods, undeclared goods, counterfeit goods, illegal goods, perishables, hazardous materials, temperature-sensitive goods, live animals, plants, currency, negotiable instruments, gift cards, precious metals, loose stones, or other goods excluded by IZI1, the carrier, or applicable law; (c) ordinary leakage, evaporation, wear and tear, gradual deterioration, hidden defect, inherent vice, latent defect, manufacturer defect, electronic malfunction not caused by external transit damage, or insufficiency of product design; (d) inadequate, improper, reused, or merchant-defective packaging, including insufficient inner cushioning or failure to prepare the goods for ordinary transit hazards; (e) seizure, confiscation, customs hold, regulatory action, sanctions issues, abandoned property procedures, return-to-sender events, refusal of delivery, invalid address, delivery barriers, recipient unavailability, or address errors; (f) acts or omissions of the User, recipient, merchant, or any person acting on their behalf, including inaccurate declarations, undervaluation, fraud, collusion, or intentional misconduct; (g) war, terrorism, cyber events, nuclear events, force majeure events, or other causes excluded under the Master Terms; or (h) any event for which recovery is sought in excess of the Protected Value or otherwise contrary to these Package Protection Terms.
- Protected Value; Valuation Rules. The maximum amount recoverable under package protection for a protected shipment will not exceed the lesser of:
- the protected value accepted by IZI1 at checkout for that shipment; (b) the actual purchase price paid for the eligible goods, excluding taxes unless expressly included, as shown by reasonably satisfactory proof of value;
- the reasonable cost to repair or replace the goods with goods of like kind and quality; or
- the actual cash value of the goods at the time of loss, taking into account age, condition, depreciation, obsolescence, use, and market factors.
- Covered Amounts. To the extent expressly included in the protected shipment valuation at checkout, recoverable amounts may also include shipping charges paid for the protected shipment, selected add-on service fees, and taxes or duties paid by the customer, in each case only to the extent specifically included in the accepted protected value and not otherwise excluded.
- Multiple Items; Allocation of Covered Amounts. If multiple goods were included in the protected shipment and only some are lost or damaged, IZI1 may allocate shipping charges, service fees, and other included charges on a pro rata basis by value, weight, quantity, or another commercially reasonable metric in its discretion. Declaring or selecting a value greater than the goods’ actual recoverable value does not increase the amount payable.
- Claim Notice; Proof; Preservation. As a condition precedent to any recovery under package protection, you must timely submit a claim in the manner designated by IZI1, together with all information and supporting materials reasonably requested by IZI1, which may include order records, invoices, payment confirmations, proof of value, photographs, packaging photographs, recipient affidavits, police reports, carrier records, serial numbers, import documents, and proof of identity. Damage claims must be supported by photographs of the outer packaging, inner packaging, and damaged goods, and you must preserve the packaging and damaged goods in the condition received until the claim is resolved or until IZI1 authorizes disposal. Theft claims may require a sworn statement from the recipient and a police or incident report where reasonably requested. Failure to provide timely notice, required documents, or preserved evidence may result in denial of the claim.
- Investigation; Cooperation; Fraud Controls. IZI1 and its Partners may investigate any package-protection claim, request additional documents or information, communicate with the carrier, merchant, recipient, payment processor, or authorities, inspect or recover the goods, and delay a claim decision while a carrier investigation, compliance review, fraud review, chargeback review, or law-enforcement inquiry is pending. You must cooperate fully and truthfully with any investigation. IZI1 may deny, suspend, reverse, or recover any payment or credit if it reasonably determines that the claim is fraudulent, collusive, unsupported, duplicated, exaggerated, legally non-compliant, or otherwise ineligible under these Package Protection Terms.
- Available Remedies; Exclusive Remedy; Payout Method. If IZI1 determines, in its discretion or as otherwise required by law, that a valid Covered Event has occurred and that all applicable conditions have been satisfied, IZI1 or the applicable Partner may satisfy the claim by any one or more of the following remedies, in its discretion:
- Replacement of the affected goods with the same or substantially similar goods, if operationally feasible;
- Payment, reimbursement, or account credit in an amount determined under these Package Protection Terms;
- Refund of all or part of the shipping charge or covered add-on service charge included in the protected value; or
- Other commercially reasonable remedy.
- Refund Payouts; Methods. Any refund, reimbursement, or payment may be made to the original payment method, by wire, by local payout method, by account credit, by offset, by coupon, or by another commercially reasonable method in IZI1’s discretion to the maximum extent permitted by law. Any stated payment period will be tolled while a claim, dispute, carrier investigation, chargeback review, fraud review, recovery effort, or legal inquiry remains pending.
- Exclusive Remedy. These remedies are your sole and exclusive remedies for any Covered Event under package protection, and package protection does not expand any other liability of IZI1, the carrier, or any Partner.
- Recoveries; Salvage; Assignment of Rights. To the maximum extent permitted by law, if IZI1 or a Partner provides any payment, credit, refund, replacement, or other value in respect of a package-protection claim, you automatically assign to IZI1 and the applicable Partner, to the extent of that recovery, all rights, claims, causes of action, and proceeds you may have against any carrier, merchant, insurer, protection provider, third-party logistics provider, recipient, or other person relating to the same loss. You agree to execute any additional documents reasonably requested to evidence or perfect that assignment. IZI1 and its Partners may also take possession of damaged, recovered, returned, or replacement goods, direct their salvage or destruction, retain any related proceeds, and recover, reverse, offset, or charge back any claim payment, credit, or remedy later determined to have been issued in error, through fraud, through duplicate recovery, or after later recovery from a third party, to the maximum extent permitted by law.
- Limitations; No Double Recovery. Without limiting the Master Terms, package protection is limited strictly to the remedies expressly stated in these Package Protection Terms and does not cover attorneys’ fees, business interruption, emotional distress, reputational harm, financing costs, customs penalties, taxes, duties, brokerage charges, reshipment losses, or any indirect, incidental, special, punitive, or consequential damages unless expressly included in an approved claim resolution. You may not recover more than once for the same loss. Any amounts recovered or recoverable from a carrier, merchant, insurer, payment processor, other third party, or another IZI1 or Partner remedy may be deducted from or offset against any amount otherwise payable under package protection.
- Cancellation; Refund of Protection Fee. The package-protection fee is non-refundable once the protected shipment has been checked out for shipment, tendered to the carrier, or otherwise placed into the protected transit flow. If IZI1 determines before carrier tender that the shipment is ineligible for package protection, that the shipment is cancelled before protection attaches, or that package protection cannot legally or operationally be provided, IZI1 may refund the package-protection fee as your sole remedy with respect to the unprovided protection. Cancellation or refund of package protection does not cancel the underlying shipment unless separately approved under the applicable service terms.
- Program Changes; Suspension; Withdrawal. To the maximum extent permitted by applicable law, IZI1 may modify, suspend, restrict, or discontinue package protection generally or for any carrier, destination, commodity, value band, or user segment at any time. Any such change will not retroactively reduce protection validly purchased for a shipment already checked out and accepted into a protected transit flow, except to the extent required by law, compelled by fraud concerns, or made necessary by legal or regulatory restrictions.
- Incorporation; Order of Precedence. These Package Protection Terms are part of the contractual framework governing the Services and are incorporated into the Master Terms. The Master Terms, including all provisions regarding claims procedures, dispute resolution, arbitration, class-action waiver, jury waiver, liability limitations, exclusions of damages, assignment, governing law, and changes to terms, apply to package protection as if fully set forth herein. In the event of a conflict between these Package Protection Terms and the Master Terms, these Package Protection Terms will control solely with respect to package protection. No statement by any merchant, carrier, customer-service representative, or other third party will alter or expand package protection unless expressly approved in writing by IZI1.
