These IZI1 TRY-IT-ON AI TERMS OF USE (these “AI Terms”) govern your access to and use of IZI1’s AI-enabled virtual try-on, image-generation, visualization, and related credit-based or usage-based features made available by IZI1 LLC (“IZI1”) or its Partners through the Platform (collectively, the “AI Tool”). These AI Terms supplement the IZI1 Master Platform Service Terms & Conditions (the “Master Terms”), the Web Terms of Use, and any other applicable service-specific terms, each of which is incorporated herein by reference.

The AI Tool is an informational and visualization service only. Unless expressly stated otherwise in writing, IZI1 does not guarantee that any AI-generated output reflects actual fit, appearance, size, color, drape, texture, availability, or real-world results, and the AI Tool does not create any seller, stylist, tailoring, medical, or professional advisory relationship.

Scope; Availability; Eligibility. The AI Tool may allow eligible Users to upload or submit images, product references, prompts, or other permitted materials in order to generate AI-produced visualizations, simulated try-on images, styling outputs, or other synthetic content for informational and shopping-enablement purposes. The AI Tool may be available only for certain Users, geographies, devices, membership tiers, feature sets, product categories, or usage levels and may be modified, limited, suspended, or discontinued at any time in IZI1’s discretion to the maximum extent permitted by law. Unless IZI1 expressly states otherwise for a particular deployment, the AI Tool is intended only for individuals who are at least eighteen (18) years of age, and you may not use the AI Tool or submit any Input if you are under eighteen (18).

Inputs; Rights and Responsibilities. You are solely responsible for all images, likenesses, prompts, text, product references, measurements, preferences, or other materials you upload, submit, transmit, link, or otherwise provide in connection with the AI Tool (collectively, “Inputs”). You represent and warrant that you have all rights, authority, consents, and permissions necessary to provide the Inputs and to permit their use in connection with the AI Tool and that the Inputs do not violate any law or infringe, misappropriate, or otherwise violate any third-party right, including any privacy, publicity, intellectual-property, confidentiality, contractual, or personal-rights interest.
Outputs; No Accuracy or Fit Guarantee. Any image, visualization, rendering, simulation, recommendation, or other content generated by the AI Tool (collectively, “Outputs”) is synthetic, illustrative, and informational only. Outputs may be inaccurate, incomplete, unrealistic, non-unique, unavailable, or similar to outputs generated for other users. IZI1 does not guarantee that any Output reflects actual fit, body shape, proportions, size, appearance, color, fabric behavior, product details, inventory status, or real-world results and does not guarantee that any product depicted in an Output is currently available or can be purchased on the displayed or any other terms. You are solely responsible for evaluating whether to rely on any Output.
Inputs and Outputs; Ownership and License to IZI1. As between you and IZI1, you retain whatever rights you may have in your Inputs, subject to the rights granted in these AI Terms and any rights of third parties. You grant IZI1, its affiliates, Partners, and service providers a limited, non-exclusive, worldwide, royalty-free right and license to host, reproduce, transmit, process, adapt, format, analyze, and otherwise use your Inputs and Outputs as reasonably necessary to provide, secure, maintain, troubleshoot, improve, and support the AI Tool and related Services, subject to the Privacy Notice and applicable law. Subject to your compliance with these AI Terms and applicable law, IZI1 grants you a limited, revocable, non-transferable right to use Outputs generated for you through the AI Tool solely for your personal, internal, and non-commercial use unless IZI1 expressly authorizes broader use in writing. IZI1 does not represent or warrant that any Output is protectable intellectual property, exclusive, or free from third-party claims.
Third-Party Images; Minors. You may not submit images or likenesses of any other person other than yourself unless you have all legally required rights and consents to do so. Without limiting the foregoing, you may not upload or submit any image of a minor, and you may not use the AI Tool in a manner that would require parental consent, guardian authorization, or any age-related authorization that has not been validly obtained.
Restrictions; Prohibited Uses. You may not use the AI Tool to generate, submit, request, or distribute any unlawful, infringing, deceptive, defamatory, threatening, abusive, harassing, malicious, or otherwise harmful content; impersonate any person; misrepresent AI-generated content as unaltered photography or verified reality where doing so would be misleading or unlawful; reverse engineer, benchmark, probe, scrape, disrupt, or misuse the AI Tool; upload malware or harmful code; use the AI Tool for competitive analysis or model-training purposes; or otherwise use the AI Tool in any manner that violates applicable law, third-party rights, the Web Terms of Use, or these AI Terms. IZI1 may suspend, limit, filter, block, or terminate access to the AI Tool if it reasonably suspects misuse, fraud, abuse, legal risk, or violation of these AI Terms.
Credits; Fees; Purchases; Expiration. Access to certain AI Tool features may require the purchase, redemption, or use of credits, usage allotments, subscription entitlements, membership benefits, or other prepaid or usage-based value. Unless otherwise required by law or expressly stated at the time of purchase, all credit or usage-value purchases are final and non-refundable, have no cash value, may not be transferred, assigned, sold, or exchanged, and may be forfeited upon fraud, misuse, suspension, or termination of your Account. Unless otherwise stated at the time of purchase, purchased credits expire twelve (12) months after the date of purchase.
Promotional Credits. promotional, courtesy, complimentary, or membership-included credits may be subject to different expiration periods, billing-cycle limits, or additional restrictions. Included recurring credits granted under a monthly or annual membership plan are limited promotional entitlements only and may expire at the end of the applicable billing cycle or benefit period unless IZI1 expressly states otherwise. IZI1 may modify pricing, credit packages, usage rates, included features, expiration policies, and redemption mechanics prospectively at any time.
Operation of the AI Tool; Third-Party Providers. The AI Tool may use artificial intelligence, machine-learning models, computer-vision systems, and third-party technology providers to process Inputs and generate Outputs. IZI1 may route Inputs, generation requests, product images, metadata, and related technical information through IZI1 systems and to one or more third-party providers as reasonably necessary to provide, secure, maintain, troubleshoot, or improve the AI Tool. Unless IZI1 expressly states otherwise for a specific feature, uploaded images are not intended to be retained on IZI1 servers for persistent storage and may instead be transmitted for session-based or request-based processing and displayed only during the applicable session or stored locally on your device if that functionality is available. Third-party providers may process request content, diagnostics, and metadata in accordance with their own service configurations and applicable contractual restrictions, and IZI1 may add, remove, substitute, or modify underlying models, providers, workflows, generation parameters, and technical processes at any time without notice.
Local Storage; Session-Based Availability. Unless expressly stated otherwise for a specific feature, IZI1 does not guarantee persistent storage of Inputs or Outputs for your later retrieval through the Platform. Inputs and Outputs may be stored only temporarily, may be displayed only during an active session, may be saved locally on your device if that functionality is available, and may become unavailable after session termination, logout, cache clearing, deletion, or technical changes. You are solely responsible for managing and deleting any files stored on your own device or through any local device feature.
Privacy; Data Handling; International Users. Your use of the AI Tool is also subject to the IZI1 latest Privacy Notice and Master Terms. To the extent Inputs, Outputs, technical logs, usage data, generation history, device data, or other information are collected, processed, stored, transmitted, or disclosed in connection with the AI Tool, such handling will occur in accordance with the Privacy Notice, these AI Terms, and applicable law. IZI1 may use service providers, cloud infrastructure, content-moderation tools, fraud-detection tools, and AI-model providers in connection with the AI Tool, and you acknowledge that transmission of Inputs and Outputs through networks and third-party systems may be necessary to provide the AI Tool.
International Users; GDPR. If you are located in the European Economic Area, the United Kingdom, Switzerland, or another jurisdiction with comparable privacy protections, you acknowledge that use of the AI Tool may involve processing of personal data, including image data that, depending on the technical operation of the feature and applicable law, could be treated as biometric data or other sensitive or special-category personal data. Where required by applicable law, IZI1 will rely on an appropriate legal basis and, where applicable, an equivalent condition, which may include your explicit consent, provision of the requested service, legitimate interests where permitted, or compliance with law. If you do not consent to such processing where consent is required, you must not use the AI Tool. You further acknowledge that your personal data may be processed in countries other than your country of residence and that, where required for restricted transfers, IZI1 will rely on recognized transfer mechanisms and safeguards, which may include adequacy decisions, Standard Contractual Clauses, the UK International Data Transfer Agreement or Addendum, or other lawful transfer tools. To the extent required by applicable law, you may have rights to access, correct, delete, restrict, object to, or withdraw consent for certain processing, subject to legal and technical limitations and the terms of the Privacy Notice.
Consent; Biometric and Identification Limitations. By using the AI Tool, you expressly authorize IZI1 and its service providers to receive, transmit, process, and, where technically necessary, temporarily cache your Inputs for the limited purpose of generating the requested Outputs and operating the AI Tool. The AI Tool is not intended for identity verification, authentication, surveillance, facial recognition, law-enforcement use, or for making decisions that produce legal or similarly significant effects concerning you, such as decisions relating to employment, credit, insurance, housing, education, or healthcare. To the maximum extent permitted by applicable law and based on the feature design described in the Privacy Notice, IZI1 does not sell, lease, trade, or otherwise profit from biometric identifiers or biometric information and does not intentionally create biometric templates for identification purposes through the AI Tool; however, you acknowledge that certain image-processing techniques used by third-party providers could be characterized differently under some laws depending on how the technology operates.
Service Disclaimers. Without limiting the Master Terms or Web Terms of Use, the AI Tool is provided on an “as available,” “as is,” experimental or evolving, and feature-specific basis. IZI1 does not guarantee successful generation, uninterrupted availability, consistent quality, error-free performance, compatibility with any device or browser, retention of generation history, or continued availability of any specific AI model, style, provider, or feature. IZI1 is not responsible for Output inaccuracies, aesthetic dissatisfaction, content similarities, model hallucinations, feature withdrawals, technical interruptions, or the acts or omissions of third-party AI or technology providers except to the extent non-waivable law requires otherwise.
Limitation of Liability; Non-Reliance. To the maximum extent permitted by applicable law, neither IZI1 nor any of its affiliates, Partners, licensors, or service providers will be liable for any indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, or for any loss of data, revenue, profits, goodwill, business opportunity, or anticipated savings arising out of or relating to the AI Tool, your Inputs, your Outputs, or your reliance on any Output. The AI Tool is not a substitute for your independent judgment, actual product inspection, professional advice, or real-world product evaluation, and you are solely responsible for any decision to purchase, rely on, share, or act on any Output.
Indemnification. To the maximum extent permitted by applicable law, you will defend, indemnify, and hold harmless IZI1, its affiliates, Partners, licensors, service providers, and their respective officers, directors, employees, agents, and contractors from and against any claims, demands, actions, losses, damages, liabilities, judgments, penalties, fines, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to your Inputs, your use of the AI Tool, your Outputs, your violation of these AI Terms, or your violation of any law or third-party right.
Incorporation; Order of Precedence. These AI Terms are part of the contractual framework governing the Services and are incorporated into the Master Terms. The Master Terms and the Web Terms of Use, including all provisions regarding accounts, intellectual property, privacy, claims procedures, dispute resolution, arbitration, class-action waiver, jury waiver, governing law, limitations of liability, exclusions of damages, assignment, and changes to terms, apply to the AI Tool as if fully set forth herein. In the event of a conflict between these AI Terms and the Master Terms or Web Terms of Use, these AI Terms will control solely with respect to the AI Tool and the matters expressly addressed herein. No statement by any customer-service representative, marketing material, AI provider, or other third party will alter or expand IZI1’s obligations unless expressly approved in writing by IZI1.
